RECOMMENDATION: It is recommended by the Transportation and  
Public Works Department that the Council, by motion, award Contract  
Number C02383, Roseland Pavement Maintenance 2024, in the  
amount of $1,999,838.90 to the lowest responsible bidder, Ghilotti  
Brothers of San Rafael, California, approve a 10% contract  
contingency, and authorize a total contract amount of $2,199,822.79.

RECOMMENDATION: It is recommended by the Communications and  
Intergovernmental Relations Office that the Council, by resolution,  
approve a First Amendment to Professional Services Agreement  
Number F002371 with Renne Public Policy Group, a division of Renne  
Public Law Group, LLP, Sacramento, California, increasing time of  
performance for two years and increasing compensation by $155,000,  
for state legislative advocacy efforts, including policy development for  
the Council’s state legislative priorities, for a total contract not to exceed  
amount of $529,580.

RECOMMENDATION: It is recommended by the Information  
Technology Department that the Council, by resolution: 1) waive  
competitive bidding pursuant to Section 3-08.100, subdivision (D) of the  
Santa Rosa City Code; and, 2) approve a contract amendment to  
F001808 for an additional six (6) year Small Enterprise Agreement with  
Environmental Systems Research Institute, Inc. (ESRI) for Geographic  
Information System (GIS) software in the amount of $1,099,800, for a  
total contract amount not to exceed $2,044,800.

RECOMMENDATION: It is recommended by the Information  
Technology and Planning and Economic Development Departments,  
that the Council, by resolution, approve a Fourth Amendment to  
General Services Agreement Number F000599 with Accela, Inc., San  
Ramon, California, for support and maintenance of software used for  
development-related permitting, inspections, and code enforcement  
services, data, and processes for a one-year extension, for a total  
renewal amount of $166,899.26, and a total cumulative contract amount  
of $1,941,641.

RECOMMENDATION: It is recommended by the Finance Department

Purchase Order 165140 with Universal Site Services, Inc., Milpitas,  
California, for sweeping services at City parking lots, garages, and  
transit hubs in an amount of $65,134.32 for a total not to exceed  
amount of $262,537.28.

RECOMMENDATION: It is recommended by the Housing and  
Community Services Department that the Council, by resolution,  
approve an extension of Resolution No. 28839 which formally  
proclaimed a local homeless emergency within Santa Rosa.

that the City Council (1) introduce an ordinance to amend chapter 6-04  
of the Santa Rosa City Code to amend the General Business Tax by  
removing the maximum tax and adjusting rates, and (2) approve a  
resolution ordering the submission of a ballot measure to seek voter  
approval of that ordinance at the November 5, 2024, General Municipal  
Election and directing related actions.

RESOLUTION - TRANSIENT OCCUPANCY TAX BALLOT MEASURE

RECOMMENDATION: It is recommended by the Finance Department  
that the City Council (1) introduce an ordinance to amend chapter 3-28  
of the Santa Rosa City Code to increase the Transient Occupancy Tax  
(TOT) by two percent (2%), and (2) approve a resolution ordering the  
submission of a ballot measure to seek voter approval of this ordinance  
at the November 5, 2024, General Municipal Election and directing  
related actions.

PUBLIC HEARING - ORDINANCE OF THE COUNCIL OF THE CITY  
OF SANTA ROSA ADDING CHAPTER 6-20 OF THE SANTA ROSA  
CITY CODE TITLED “REGULATION OF RETAIL TOBACCO SALES,”  
AUTHORIZE THE CITY MANAGER TO NEGOTIATE AND EXECUTE  
AN AGREEMENT WITH THE COUNTY FOR COMPLIANCE  
MONITORING AND ENFORCEMENT  
BACKGROUND: The City Council will consider an ordinance that  
proposes adding Chapter 6-20 to the Santa Rosa City Code titled  
“Regulation of Retail Tobacco Sales” requiring all tobacco retailers to  
obtain a license and comply with enhanced regulations associated with  
tobacco sales, in particular, those targeting sales to youth. The  
ordinance incorporates direction from Council provided during their  
June 4, 2024, meeting revising sections associated with license transfer  
language and the level of fines and penalties. The revised ordinance  
does not alter the proposed language to establish a buffer between  
retail locations and schools and parks, a ban on electronic tobacco  
smoking devices and flavored tobacco sales, and establishment of  
minimum package sizes and pricing. If adopted, the ordinance will  
impose a license fee on retailers selling tobacco products within the  
City limits. Staff will return to Council with a resolution to impose any  
such fees.  
RECOMMENDATION: It is recommended by the City Manager’s Office  
that the Council: 1) hold a public hearing to discuss regulation of retail  
tobacco sales; 2) introduce an ordinance adding Chapter 6-20 to the  
Santa Rosa City Code titled “Regulation of Retail Tobacco Sales”; and  
3) by motion, authorize the City Manager to negotiate and execute an  
agreement with the County of Sonoma for license administration and  
compliance monitoring.

PUBLIC HEARING - SANTA ROSA FIRE DEPARTMENT ANNUAL  
WEED ABATEMENT PROGRAM REPORT  
BACKGROUND: Santa Rosa City Code section, Chapter 9.08 requires  
a public hearing to hear objections to the cost of weeds and/or rubbish  
abatement. The City Council grants or overrules such protests.  
The City Council, by resolution, may confirm the itemized report of the  
costs of abatement. The City Council authorizes the Santa Rosa Fire  
Department, County Auditor and Tax Collector to enact a special  
assessment as a lien upon respective parcels subject to the Weed and  
Rubbish Abatement Program.  
RECOMMENDATION: It is recommended by the Santa Rosa Fire  
Department that the Council, by resolution, confirm the itemized report  
of the Fire Department of the cost of weed and rubbish abatement as  
provided for in Sections 9-08.020, 9-08.080, and 9-08.090 of the Santa  
Rosa City Code.
